South Walton Fire District advises on fireworks usage

The Fourth of July is around the corner, a time many Americans observe their independence by sending bottle rockets into the sky, exploding miniature bombs and unfortunately, breaking a state law. Most fireworks according to Florida State Statute 791 are illegal for consumer use in Florida, even if they’re available for purchase. That can make stocking up for celebrations confusing for residents, tourists and guests alike.

Fireworks that explode, fly or lift off (including the popular Roman candles) are considered illegal fireworks under Florida Statute 791.Often times it is presumed that it is acceptable, safe and legal to shoot fireworks off the beach area. This is not only illegal but it causes a huge trash issue since most people do not clean up the debris that is left over.

Walton County ordinance clearly states “Fireworks displays south of the Choctawhatchee Bay shall require a permit from the SWFD, and may only be issued to a person or company maintaining a valid, current Bureau of Alcohol, Tobacco and Firearms Explosive (BATFE) license. At a minimum this shall be a low explosive license.”

Only a few fireworks are considered “legal” and generally approved for use by consumers which include sparklers; small fireworks that emit colored smoke only; and “glow worms,” which burn in bright colors without exploding.
